The agency’s fees are payable by the BUYER.
The calculation basis is the sale price excluding fees (net to the seller).
In the case of a joint-agency sale, our fees will not exceed the values stated in this schedule.
Where the buyer has given a search mandate to another real-estate professional, the agency’s fees are also due.
RENTALS (LOCATION)
Reminder of the provisions of Article 5 (I) of the law of 6 July 1989, paragraphs 1 to 3:
“The remuneration of persons mandated to carry out or assist with the brokering or negotiation of the letting of a dwelling, as defined in Articles 2 and 25-3, is borne exclusively by the LANDLORD, except for fees relating to the services mentioned in the second and third paragraphs of this I.
The fees of persons mandated to carry out the tenant’s viewing, build the tenant’s file and draft a lease are shared between the LANDLORD and the tenant. The amount, including all taxes, charged to the tenant for these services may not exceed that charged to the LANDLORD and remains at or below a ceiling per square metre of living area of the rented property, set by regulation and revisable each year under conditions defined by decree. These fees are due upon signing the lease.
The fees of persons mandated to carry out an inventory of condition (état des lieux) are shared between the LANDLORD and the tenant. The amount, including all taxes, charged to the TENANT for this service may not exceed that charged to the LANDLORD and remains at or below a ceiling per square metre of living area of the rented property, set by regulation and revisable each year under conditions defined by decree. These fees are due as from performance of the service.”
Applicable ceilings:
– ceiling on fees chargeable to tenants for the tenant’s viewing, file building and lease drafting: €12/m² of living area (very tight-market zone); €10/m² of living area (tight-market zone); €8/m² of living area (rest of the territory);
– ceiling on fees chargeable to tenants for the move-in inventory of condition: €3/m² of living area.
Brokering and negotiation fees (Landlord):
Fees chargeable for brokering and negotiating the letting of the property: 10% of the annual rent excluding charges.
Fee rates are stated including VAT (current VAT rate: 20%).
